01Owner of the website

In accordance with article 10 of Spanish Act 34/2002 of 11 July, on information society services and electronic commerce (LSSI-CE), the identifying details of the owner of this website are set out below.

02Purpose and acceptance

This legal notice governs access to and use of the website pemagabuildings.com and of its subdomains and sections. The site has an informative and commercial purpose: to present the services of PEMAGA Building, show how the company works and let any person or organisation get in touch to ask for a quote.

Browsing this website makes you a user and means you accept these terms as published at that moment. If you do not agree with any of them, the answer is simple: do not use the site.

This site is not a shop. Nothing is contracted from here: work is always contracted in writing, through the signed acceptance of a quote and, where applicable, of the corresponding construction contract.

03Terms of use

Access to the website is free of charge, other than the cost of the connection the user has with their own provider. The user undertakes to use the site in accordance with the law, with good faith and with this legal notice, and in particular not to:

• Use the site for unlawful purposes, in a way that harms the rights of third parties, or that may damage, overload or prevent the normal operation of the service.
• Introduce or spread viruses, malicious code or any system that may alter the site, the equipment or the information systems of PEMAGA Building or of third parties.
• Attempt to access restricted areas, other people's accounts or data held in the owner's systems without authorisation.
• Reproduce, copy, systematically extract or reuse the contents of the site beyond what is allowed in the intellectual property section.
• Impersonate other people or supply false details in the contact forms.

The owner may refuse or withdraw access to the site, without prior notice, to anyone who breaches these terms.

04Intellectual and industrial property

All the contents of the site —texts, navigation structure, graphic design, source code, style sheets, illustrations, icons, diagrams, and the selection and arrangement of the contents— belong to PEMAGA Building SL or to third parties who have authorised their use, and are protected by Spanish Royal Legislative Decree 1/1996 of 12 April, approving the consolidated text of the Intellectual Property Act, and by the applicable industrial property rules.

Access to the site does not grant the user any right over those contents. Their reproduction, distribution, public communication, transformation or any other form of exploitation without the express written authorisation of the owner is prohibited.

What you may do

• View the contents and make private copies for your own personal, non-commercial use, without altering them.
• Link to any page of the site on the terms set out in section 07.
• Quote short passages, stating the source and linking to the original, in line with the right of quotation in article 32 of the Intellectual Property Act.

The names PEMAGA, PEMAGA Building, PEMAGA Home and Grupo PEMAGA, together with their logos and distinctive signs, are signs of Grupo PEMAGA. Use by third parties requires prior authorisation.

The images that illustrate this site are stock photographs of building work obtained under an Unsplash licence, used for illustrative and editorial purposes. Unless a caption expressly says otherwise, they do not correspond to work carried out by PEMAGA Building, they do not identify clients or employees of the company, and they should not be read as a sample of any particular job.

The rights over those photographs belong to their respective authors on the terms of the licence under which they are distributed. The licence covering their use on this website does not extend to anyone who downloads them from here: if you need an image, go to the original source.

Third-party trademarks

Häcker is a registered trademark of Häcker Küchen GmbH & Co. KG. Any mention of that trademark on this site is nominative and descriptive: it serves only to identify the kitchens supplied by PEMAGA Home, another division of Grupo PEMAGA, under article 14 of Regulation (EU) 2017/1001 on the European Union trade mark and article 37 of Spanish Act 17/2001 on trademarks. It does not imply that this site belongs to Häcker Küchen GmbH & Co. KG, nor that the company sponsors or endorses it.

Any other third-party trademarks, trade names and logos that may appear belong to their owners and are likewise cited nominatively, without implying any link, sponsorship or mutual recommendation.

06Disclaimer

PEMAGA Building SL takes reasonable care to keep the published information accurate and up to date, but cannot guarantee that it is free of typing errors, omissions or outdated material. It reserves the right to correct it at any time.

In particular, and save for wilful misconduct or gross negligence on the owner's part, liability is excluded for:

• Damage arising from interruptions, errors, delays or faults in access to the site, or from the presence of viruses or malicious programs on the user's equipment.

08Client portal

The client portal reached from this website (panel.grupopemaga.com) is a restricted area. Credentials are named, personal and non-transferable and are issued by the PEMAGA Building office: there is no open sign-up.

• The user is responsible for keeping their password safe and for everything done from their account. If they suspect that someone else knows it, they must say so immediately.
• The information visible in the portal —quotes, measurements, amounts, photographs and messages— is confidential and is provided for the management of the client's own job.
• Logins and actions taken are recorded for security and traceability.
• The owner may suspend or cancel an account for improper use or once the contractual relationship has ended.

09Data protection

The processing of the personal data collected through this website and through the client portal is set out in the privacy policy, which forms part of this legal notice. It explains who the controller is, for what purpose and on what legal basis the data are processed, how long they are kept, who they are disclosed to and how to exercise the rights granted by Regulation (EU) 2016/679 and by Spanish Organic Act 3/2018.

10Availability of the service

The owner aims to keep the site available continuously, but does not guarantee permanent availability or the absence of interruptions. Access may be suspended temporarily for maintenance, updates, migrations or incidents affecting the hosting provider, without this giving rise to any right to compensation.

11Changes

PEMAGA Building SL reserves the right to change the presentation, configuration and contents of the site at any time, as well as these terms. Changes apply from the moment they are published. The date of the last revision appears at the top of this page; it is worth checking now and then.

12Governing law and jurisdiction

This legal notice and the relationship between PEMAGA Building SL and the user are governed by Spanish law, in particular by Act 34/2002 (LSSI-CE), Royal Legislative Decree 1/1996 (Intellectual Property Act), Regulation (EU) 2016/679 (GDPR) and Organic Act 3/2018 (LOPDGDD).

Where the user is a consumer, the competent court is the one determined by the applicable consumer rules, which as a general rule is that of the consumer's place of residence; a consumer user may also turn to the consumer bodies of their municipality or of the Generalitat de Catalunya. In all other cases, the parties submit, expressly waiving any other jurisdiction, to the courts of Barcelona.
